SPRS TERMS AND CONDITIONS

The use of the Short Position Reporting System web site ("SPRS") shall be subject to the terms and conditions set out below (collectively referred to as "SPRS’ Terms of Use").


General


  1. The Terms of Use (except for the section on Restrictions on use of Materials) of the Monetary Authority of Singapore ("MAS") web site shall apply, mutatis mutandis, to the use of SPRS as if it were set out herein, but with the references to "this Web Site" in the Terms of Use of the MAS web site being replaced with "SPRS".
  2. The MAS Internet Privacy Policy Statement of the MAS web site and the Government Agency Privacy Statement shall apply, mutatis mutandis, to the use of SPRS as if it were set out herein, but with –
    • the references to "our web-site", “our website”, “this website” and “website”, in the MAS Internet Privacy Policy Statement of the MAS web site being replaced with "SPRS"; and
    • the reference to “this website” and “This site” in the Government Agency Privacy Statement being replaced with “SPRS”.
  3. For the avoidance of doubt, in the event of any conflict or inconsistency between the terms of the MAS Internet Privacy Policy Statement of the MAS website and the terms of the Government Agency Privacy Statement, the terms in the MAS Internet Privacy Policy Statement of the MAS website shall prevail.
  4. By accessing and using any part of SPRS, you shall be deemed to have agreed to be legally bound by SPRS’ Terms of Use. If you do not agree to SPRS’ Terms of Use, please do not use SPRS.
  5. SPRS’ Terms of Use may be changed from time to time, without prior notice to you, and your use of SPRS after such changes have been posted on the MAS web site or SPRS will constitute your agreement to the modified SPRS’ Terms of Use.


Restrictions on use of Materials


  1. Except as otherwise provided, the materials located on SPRS, including the information as well as any software programs available on or through SPRS, (“Contents”) shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of MAS.
  2. You may download one copy of any information provided in SPRS onto a single computer for your own personal non-commercial use, or for your own information in relation to making any investments, provided that you keep intact all accompanying copyright and other proprietary notices.
  3. Modification of any of the Contents or use of the Contents for any purpose, other than your personal non-commercial use or for your own information in relation to making any investments, will be a violation of MAS's copyright and other intellectual property rights. Graphics and images on SPRS are protected by copyright and may not be reproduced or appropriated in any manner without the written permission of their respective copyright owners.


Additional Disclaimer of Warranties and Liability


  1. The reporting of any short position through or on SPRS with MAS does not imply that the relevant legal and regulatory requirements have been complied with. The requirements for reporting of short positions, including establishing the identities of the market participants holding short positions and their reporting agents, are pursuant to the Securities and Futures Act (Cap. 289) and regulations issued thereunder.
  2. The Contents of SPRS do not constitute investment or financial advice on the markets. Neither should the publication of any information (whether aggregated or not) in relation to any short position be taken as a recommendation or endorsement by MAS for any investment decision. If advice on any investment decision is needed, the services of a competent professional should be sought.
  3. The information (whether aggregated or not) in relation to any short position which is published on SPRS, is provided by market participants holding short positions and their reporting agents. MAS does not warrant and hereby disclaims any warranty as to the accuracy, or fitness for any particular purpose, of the information (whether aggregated or not) in relation to any short position which is published on SPRS. MAS does not warrant and hereby disclaims any warranty that SPRS will contain all the information investors need to determine the merits of any investment decision. MAS shall not be liable for any damage or loss of any kind, howsoever caused as a result (direct or indirect) of the use of SPRS, or any information or data contained in or available on SPRS, including but not limited to any damages or loss suffered as a result of reliance on the information or data contained in or available on SPRS.


Governing Law


  1. SPRS’ Terms of Use shall be governed by and construed in accordance with the laws of Singapore.
